TOWN OF DUXBURY CONSERVATION COMMISSION

PUBLIC MEETING

The Duxbury Conservation Commission will hold a Public Meeting in the Mural Meeting Room, Lower Level, Town Hall, under the Town of Duxbury Wetlands Bylaw, Chapter 9 and Massachusetts Wetlands Protection Act, MGL, Ch. 131, Section 40, on Tuesday evening, December 19, 2017 at 7:15 p.m. on the request of Duxbury Construction LLC to determine the applicability of the Massachusetts Wetlands Protection Act and the Town of Duxbury Wetlands Bylaw relative to a project described in a Request for Determination of Applicability filed with the Conservation Commission December 4, 2017. Said project is to remove silt and sediment from the bottom of a reservoir and is located at 106 Harrison Street, Lot 107-008-003 of the Duxbury Assessors Map.

The Duxbury Conservation Commission will hold a Public Hearing in the Mural Meeting Room, Lower Level, Town Hall, under the Town of Duxbury Wetlands Bylaw, Chapter 9 and Massachusetts Wetlands Protection Act, MGL, Ch. 131, Section 40, on Tuesday evening, December 19, 2017 at 7:20 p.m. on the request of Duxbury Construction LLC to construct a drift fence as described in a Notice of Intent filed with the Conservation Commission on December 4, 2017. Said project is located at 230 Marshall Street, Lot #122-096-079 of the Duxbury Assessors Map.

Said project is located at 54 Chapel Street, Lot #118-191-000 of the Duxbury Assessors Map.

MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE

By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Timothy J. Coffey and Carol W. Chubb to Option One Mortgage Corporation, a California Corporation, dated March 3, 2004 and recorded with the Plymouth County Registry of Deeds at Book 27688, Page 173 subsequently assigned to Wells Fargo Bank, N.A., as Trustee for Option One Mortgage Loan Trust 2004-2 Asset-Backed Certificates, Series 2004-2 by Sand Canyon Corporation fka Option One Mortgage Corporation by assignment recorded in said Plymouth County Registry of Deeds at Book 42619, Page 27; of which Mortgage the undersigned is the present holder for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 2:00 PM on December 20, 2017 at 782 Temple Street, Duxbury, MA, all and singular the premises described in said Mortgage, to wit: Acertain parcel of land with the buildings thereon lying on the Southwesterly side of Temple Street, in Duxbury, Plymouth County, Massachusetts, being more particularly bounded as follows:NORTHWESTERLY: by Lot 1, as shown on the plan hereinafter described, one hundred fifty-five and 00/100 (155.00) feet; WESTERLY: by said Lot 1, as shown on said plan fiftyseven and 92/100 (57.92) feet; NORTHEASTERLY: by Lot 1B, as shown on said plan one hundred seventy-four and 64/100 (174.64) feet; WESTERLY: (again) by land now or formerly of George L. Containing 114,646 square feet according to said plan and being shown as Lot 1A on a plan entitled “Compiled Plan of Land in Duxbury, Mass., prepared for Edward J Reilly”, dated August 25, 1982 by Associated Engineers of Plymouth Inc., which plan is recorded as Plan 720 of 1982 in Plan Book 23, Page 431. Being the same premises conveyed to the herein named mortgagor (5) by deed recorded with Plymouth County Registry of Deeds in Book 8762, Page 196. Upon information and belief, there are errors in the legal description attached to the mortgage, wherein the third, sixth and seventh bounds should read, respectively: Northwesterly: by Lot 1B, as shown on said plan one hundred seventy-four and 64/100 (174.64) feet; Southeasterly: by land now or formerly of Francis P. Sullivan, as shown on said plan two hundred eighty and 24/100 (280.24) feet; Southeasterly: (again) by land now or formerly of said Sullivan two hundred five and 32/100 (205.32) feet; The premises are to be sold subject to and with the benefit of all easements, restrictions, building and zoning laws, liens, attorney’s fees and costs pursuant to M.G.L.Ch.183A, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession. TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.
